Worker’s Compensation Legislation

Attempts to rollback hard fought reforms to the California Worker’s Compensation Committee were stopped.

SB 145 (DeSaulnier) – Provides that no workers’ compensation claim can be denied because the employee’s injury or death was related to the employee’s race, religious creed, color, national origin, age, gender, marital status, sex, sexual orientation, or genetic characteristics. Also prohibits race, religious creed, color, national origin, age, gender, marital status, sex, sexual orientation, or genetic characteristics from being considered a cause or other factor of disability when doing apportionment. (Stopped in Committee)

SB 186 (DeSaulnier) - Deletes the Dec. 31, 2009, sunset pertaining to an employee’s pre-designation of a personal physician. (Vetoed by the Governor)

SB 773 (Steinberg) – Seeks to enact legislation that would adjust the amount of permanent partial disability benefits paid to workers so that the benefits are fair, adequate, and more favorably aligned when compared with permanent partial disability benefits paid to workers in other states. (Stopped in Committee)
